The European Court of Human Rights is an international court set up in 1959. It rules on individual or State applications alleging violations of the civil and political rights set out in the European Convention on Human Rights. Since 1998 it has sat as a full-time court and individuals can apply to it directly. The Court examined hundreds of thousands applications since it was set up. Its judgments are binding on the countries concerned and have led governments to alter their legislation and administrative practice in a wide range of areas. The Court’s case-law makes the Convention a modern and powerful living instrument for meeting new challenges and consolidating the rule of law and democracy in Europe. --- Instituée en 1959, la Cour européenne des droits de l’homme est une juridiction internationale compétente pour statuer sur des requêtes individuelles ou étatiques alléguant des violations des droits civils et politiques énoncés par la Convention européenne des droits de l’homme. Depuis 1998, la Cour siège en permanence et peut être saisie directement par les particuliers. La Cour a examiné des centaines de milliers de requêtes depuis sa création. Ses arrêts, qui sont obligatoires pour les Etats concernés, conduisent les gouvernements à modifier leur législation et leur pratique administratives dans de nombreux domaines. La jurisprudence de la Cour fait de la Convention un instrument moderne, dynamique et puissant pour relever les nouveaux défis et consolider l’Etat de droit et la démocratie en Europe.

Do you have the following requirements? 📌 hold a higher education degree or qualification in law of a standard permitting access, either on the basis of qualifications or after passing a competitive examination, to the judicial administration or legal professions in Italy (as from 1999: "Laurea Triennale in scienze giuridiche" and "Laurea specialistica" or "Magistrale in giurisprudenza" (5 years); before 1999: 4 years' degree in law); the law degree must have been obtained in Italy; 📌 after having obtained the relevant university degree in law, have at least two years of professional experience acquired in the legal field (preferably in the judicial service) in Italy or in international organisations on tasks also related to national law; 📌 have an excellent knowledge of Italian (first language level); 📌 have very good knowledge of one of the two official languages of the Council of Europe (English or French) and knowledge of the other; 📌 have the ability to draft legal texts clearly and precisely in English or French; And eligibility criteria? 📌 be a citizen of one of the member states of the Council of Europe and fulfil the conditions for appointment to the civil service of that state; 📌 have discharged any obligation concerning national service (military, civil or comparable); 📌 not be the parent, child, stepchild or grandchild of a serving staff member of the Council of Europe; 📌 be under the age of 65 years. ➡️ Semenya v. Switzerland ⚖️ The Court held that there had been a violation of the right to a fair hearing. 🔹 The case concerned an international-level athlete, specialising in middle-distance races, who complained about certain regulations of the International Association of Athletics Federations, now called World Athletics, requiring her to take hormone treatment to decrease her natural testosterone level in order to be able to take part in international competitions in the female category. Having refused to undergo the treatment, she was no longer able to take part in international competitions. --- ➡️ Semenya c. Suisse ⚖️ La Cour a conclu à la violation du droit à un procès équitable. 🔹 L’affaire concernait une athlète de niveau international, spécialisée dans des courses de demi-fond, qui se plaignait d’un règlement de l’« IAAF », désormais World Athletics, qui l’obligeait à réduire son taux naturel de testostérone par des traitements hormonaux pour pouvoir participer aux compétitions internationales dans la catégorie féminine. Refusant de se soumettre audit traitement, la requérante n’a pas pu participer aux compétitions internationales.

⚖️ Ukraine and the Netherlands v. Russia
Today, the European Court of Human Rights delivered one of the most consequential judgments in its history, in the interstate case of Ukraine and the Netherlands v. the Russian Federation. The Court held Russia accountable for widespread and systematic violations of the European Convention on Human Rights in the context of its actions in Ukraine. This judgment addresses grave allegations, including inter alia: •The downing of Malaysia Airlines flight MH17, •Arbitrary detention, torture, and extrajudicial killings in eastern Ukraine, •The unlawful deportation of Ukrainian children. The Court concluded that these violations were not isolated incidents but part of a coordinated and deliberate pattern of conduct attributable to the Russian authorities. This judgment reaffirms the enduring relevance of the Convention system and the Court’s role as a guardian of human rights in Europe.
