📣 While Eyes Are on Medicaid Cuts, the Real Storm Is Brewing Elsewhere Over the past few weeks, headlines have zeroed in on potential Medicaid reductions tied to federal legislation related to passage of the Trump administration’s proposed “Big, Beautiful Bill.” But as attention stays locked on what might happen in Congress, many providers are missing what’s already unfolding — and it could have a far greater impact on their organizations: 🔎 Federal agencies are moving quickly and decisively to expand healthcare enforcement, both civil and criminal. In just the past 60 days: 1. DOJ named healthcare fraud its #1 white-collar crime priority → Expanded criminal prosecution, especially for Medicare, Medicaid, TRICARE, and elder fraud → Reassignment of prosecutors to healthcare fraud units in 15 districts → Targeting of kickbacks, DME, opioid prescribing, and AI-enabled fraud 2. A new DOJ-HHS False Claims Act Working Group was launched → Full coordination between CMS, OIG, and U.S. Attorneys → Focus areas: risk adjustment, EHR manipulation, pricing/discount schemes, and network adequacy 3. CMMI launched WISeR, a test model using prior authorization and pre-payment review for services CMS deems overused or unsupported 4. CMS is auditing all Medicare Advantage plans, retroactively to 2018–2024, with AI-supported targeting 5. More than 300 people were charged last week in a DOJ takedown totaling $14.6 billion in healthcare fraud 📌 And if that wasn’t enough, DOJ just revised its Corporate Enforcement Policy to push companies toward voluntary self-disclosure — or face harsher penalties. So here’s the real question for healthcare organizations: While you're watching Congress debate Medicaid, 👉 Are you prepared for the audit or subpoena that could land this quarter? 👉 Have you evaluated your risk adjustment exposure, staffing data, and partner networks? Because CMS, DOJ, and OIG aren’t waiting for legislation. They're already auditing, prosecuting, and recovering.
